WILLS
Without a valid will, legislation will determine who shall receive the assets you have worked so hard and sometimes a lifetime to obtain. Such legislation quite often provides a result which is unfair, leaving your deceased estate exposed to very expensive litigation.
A valid will allows you as the testator to determine:
· Who shall be the executors and trustees of your estate;
· Which specific gifts such as jewellery and family heirlooms shall be given to particular beneficiaries;
· Who shall receive a share in the balance of your estate;
· Appointment of Guardians of children.
· Specific funeral intentions.
Whilst many wills are not required to be overly complex, no two wills are ever the same, accordingly it is important to carefully consider the options which are available to you.
We are also able to provide an estate planning service which includes consideration of asset protection, taxation benefits, life estates and the various types of testamentary trusts.
You need to think carefully about who should be your executors and make sure that they are agreeable to take on the job. If you have infant children then you should ask those you wish to be guardians if they will be happy to accept that position.
We are able to hold your Wills for safe keeping in our strongroom. This is a free service that we offer our clients.
POWERS OF ATTORNEY
The best time to put in place a Power of Attorney is before you actually need it. There are many issues involved in appointing an attorney including such as:
· Who should be my attorney?
· If there is more than one person should they act together or individually?
· Is the Power to be effective now, or from a particular date, or in only particular circumstances?
· Do you want to set any limitations on your attorney?
Attorneys can be appointed for financial matters, medical treatment and lifestyle decisions.
